VARTA strongly encourages people considering surrogacy to make these arrangements within Australia. The unregulated environments that occur overseas can pose potentially serious risk or disadvantage for all parties involved in surrogacy arrangements – in particular, for resulting children. However, recognising that international arrangements do occur, the following checklist has been compiled in collaboration with Kellehers Australia. This checklist is a modification of the checklist devised and created by Kellehers Australia.

Legislation to remove police checks passed by parliament 

Headline: Legislation to remove police checks passed by parliament 
Starting from 8 July 2020 people will no longer have to have police and child protection order checks before starting fertility treatment in Victoria after state parliament passed legislation removing the requirement. 
 
The legislation, known as the Assisted Reproductive Treatment Amendment Bill 2020, was passed by the Legislative Council on 4 June 2020 and will come into effect on 8 July 2020.

Mother and son talk surrogacy

Karen and her son Matt speak about surrogacy at VARTA's Time to Tell Seminar.  Surrogacy was not permitted years ago in Australia so Karen and her husband needed to travel to the US.  Through a surrogacy agency they found a surrogate who remains a friend.  Matt has grown up knowing her and the reasons why she carried him for his parents.  He says, 'I'm glad it was never a sercret... everyone has a right to know who they are and where they come from.

New regulations starting December 2019

New regulations made under the Assisted Reproductive Treatment Act 2008, the Assisted Reproductive Treatment Regulations 2019 (the new regulations), start on December 13, 2019, and replace the earlier regulations which will no longer operate.
